Terms of Service

These terms constitute a legally binding agreement between you ("Client") and Preston-Schwartz Moving ("Carrier"). By scheduling service, you accept these terms in full.
1. Estimates & Final Pricing
1.1 Non-Binding Estimates: All quotes provided online, over the phone, or via email are non-binding estimates based on the inventory and conditions reported by the Client.
1.2 Final Charges: Final charges are determined by the actual time elapsed (for hourly local moves), actual weight/mileage (for long-distance), or actual volume filled in the truck (for junk removal).
1.3 Right to Revise: We reserve the right to revise the estimate on the day of service if the inventory is significantly different than reported, or if access conditions (e.g., undeclared flights of stairs, elevators out of service, long carries >75ft) were not disclosed.
2. Carrier Liability & Valuation
In compliance with Indiana Department of Revenue and Federal Motor Carrier Safety Administration (FMCSA) regulations, we offer two levels of liability coverage:
Option A: Released Value (Standard)
Included at no extra cost. Liability is limited to $0.60 per pound per article.
Example: If a 50lb TV valued at $500 is smashed, payout is $30 (50lbs x $0.60).
Option B: Full Value Protection
Available for an additional premium. Carrier is liable for the replacement value or repair cost of lost/damaged items, subject to a deductible declared on the Bill of Lading.
Liability Exclusions (We are NOT liable for):
- Packed by Owner (PBO): Damage to contents of boxes packed by the Client, unless the box itself shows significant external physical damage caused by our handling.
- Engineered Wood/Particle Board: Furniture made of press-board (e.g., IKEA) is designed to be assembled once. We are not liable for joints loosening or crumbling during transport.
- Electronics: Internal mechanical or electronic failure of devices (TVs, computers, washers) absent visible external impact damage.
- Undeclared High Value: Items valued over $100/lb (jewelry, cash, antiques) must be explicitly listed on a High Value Inventory form. Carrier is not liable for cash, deeds, or documents.
3. Junk Removal Terms
- 3.1 Prohibited Items: We cannot strictly accept hazardous materials, including but not limited to: Paint (liquid), Asbestos, Chemicals, Motor Oil, Fuel, Medical Waste, or Sealed Drums.
- 3.2 Transfer of Title: Ownership of items transfers to Preston-Schwartz Moving only once items are loaded onto our truck. We are not liable for items left on the curb prior to our arrival.
- 3.3 Bed Bugs/Biohazards: We reserve the right to refuse service immediately if evidence of bed bugs or biological hazards is found. A cancellation fee may apply.
4. Rescheduling & Cancellations
- 48-Hour Notice: Cancellations or reschedule requests must be made at least 48 hours prior to the scheduled start time to avoid penalty.
- Late Cancellation Fee: Cancellations within 24 hours of service are subject to a fee equivalent to the 1-hour minimum labor rate or the base trip fee.
- Force Majeure: Neither party shall be liable for delays caused by acts of God, severe weather (snow emergencies), or road closures. In such cases, we will reschedule at the earliest mutual convenience.
5. Payment Terms
Payment is due in full immediately upon completion of services (before the crew departs). We accept Credit Cards, Debit Cards, and Cash.
Delinquency: Unpaid invoices after 30 days will accrue interest at the maximum rate allowed by Indiana law (8% per annum). Client is responsible for all collection costs and reasonable attorney fees.
6. Right of Refusal
Our crew has the right to stop work and retreat from any job site that is deemed unsafe, unsanitary, or abusive. This includes but is not limited to: structural instability, presence of aggressive pets, hostile behavior, or severe hoarding conditions blocking safe egress.
